The Plaintiff in this case is seeking to enforce a consent order against Janah binti Abdullah (“the deceased”) recorded in Court, against the 1st Defendant who is the administrator of the estate of the deceased, by this Originating Summons (“OS”). Conclusion 13. Apart from non-compliance of the Rules the Court also finds that the OS is barred by laches and limitation as well as not a proper mode to execute the Judgement. In the upshot the Court dismissed the Plaintiff’s OS with a cost of RM5,000.
