The Plaintiff in this case is seeking to enforce a consent order against Janah binti Abdullah (“the deceased”) recorded in Court, against the 1st Defendant who is the administrator of the estate of the deceased, by this Originating Summons (“OS”). 1 Conclusion 1 13. Apart from non-compliance of the Rules the Court also finds that the OS is barred by laches and limitation as well as not a proper mode to execute the Judgement.
