Morgan Tsen appears in the corpus in Sabah land and injunction litigation, argued in the Court of Appeal (Mahkamah Rayuan). Two related appeals, appearing for the respondent in one and the appellant in the other, concerned an allegation of contempt of court for breaching an interim injunction: the question was whether the respondents had wilfully and deliberately disobeyed or disregarded the terms of the court's injunction order by refusing the applicant the use of an access road. The court affirmed the important principle that intention or mens rea is not an essential ingredient for a finding of contempt in general, but held that whether the respondents intended to commit contempt must be determined by reference to all the facts and circumstances, and concluded on the facts that they had given strong reasons for not allowing the use of the access road and that their conduct fell far short of the wilful or deliberate disobedience required. A third matter, appearing for the appellant, concerned communal title in Sabah and engaged a distinctive body of land law: the position of the Collector as trustee under the Sabah Land Ordinance, the interests of native beneficiaries, timber extraction under a Form 2B licence and the conversion of land to oil-palm plantation, the roles of the Sabah Land Development Board and the forestry authorities, and questions of unlawful interference, locus standi and interim injunctive relief. Across the appearances the practice is concentrated on the East Malaysian land regime and on the enforcement of court orders by contempt, where the threshold for finding wilful disobedience and the standing of native beneficiaries to protect communal land are recurring themes. The two contempt appeals in particular show how a dispute over access to land can escalate into a contest over whether a party has defied the court itself.
