In this practice area

Family Law collects the disputes arising from marriage and its breakdown under the Law Reform (Marriage and Divorce) Act 1976, together with questions of custody, maintenance and the division of matrimonial assets. The area concerns the civil (non-Muslim) family jurisdiction; matters governed by Islamic law are gathered separately.

Division of matrimonial assets is a central subject. Judgments apply section 76 of the Law Reform (Marriage and Divorce) Act 1976 to decide what property is matrimonial, the proportion of each spouse's entitlement, and the treatment of assets such as the matrimonial home and a professional practice. Custody, care and control, and the distinction between guardianship and custody under the Guardianship of Infants Act 1961, form a second strand, alongside the assessment of maintenance — including interim maintenance limited to the immediate living needs of a spouse.

Procedure specific to matrimonial causes recurs.
