Whether damages are an adequate remedy?; Held: Court finds that there are arguably bona fide serious issues to be tried to determine the validity of the termination of the sale and purchase agreement and whether there was fulfilment of the conditions precedent within the CP period. The Court however finds that the balance of convenience lies in favour of disallowing the injunction and that damages are an adequate remedy. The injunction application is dismissed with costs.
