Case Significance

A defendant's Order 14 rule 5 summary judgment on its counterclaim between two property companies, granted but with execution stayed pending trial of the plaintiff's own claim.

This High Court decision concerns an application by a defendant, under Order 14 (and specifically Order 14 rule 5) of the Rules of Court 2012, to enter final judgment against the plaintiff on the defendant's counterclaim. Order 14 rule 5 extends the summary-judgment procedure to a counterclaim, allowing a defendant to obtain judgment on it where the plaintiff has no defence to the counterclaim and raises no genuine triable issue. The dispute arose between two property companies, the plaintiff being the owner of a piece of land, and the counterclaim asserted a liability of the plaintiff to the defendant.

The Court applied the established summary-judgment threshold from the defendant's side of the record: just as a plaintiff may obtain summary judgment where the defendant discloses no defence, a defendant may obtain summary judgment on its counterclaim where the plaintiff, as defendant to that counterclaim, shows no bona fide issue to be tried. The Court was satisfied that the plaintiff had no defence to the counterclaim that warranted a trial, and accordingly allowed the application and entered summary judgment on the counterclaim.

Recognising, however, that the plaintiff's own claim against the defendant remained to be tried, and that it would be unjust to permit the counterclaim judgment to be executed while that claim was still live and might affect the overall position between the parties, the Court stayed execution of the summary judgment until the disposal of the plaintiff's claim. The plaintiff, dissatisfied, lodged an appeal. It also shows the court holding the balance between the parties: a defendant may obtain judgment on a clear counterclaim without awaiting trial, yet the court may withhold the fruits of that judgment by staying execution until the opposing claim, capable of affecting the net position, has been determined. The judgment is a useful illustration of the availability of summary judgment on a counterclaim under Order 14 rule 5, and of the court's discretion to stay execution of such a judgment pending the trial of the opposing claim so as to hold the balance between the parties.
