This case concerns an application by the Public Prosecutor for a stay of execution under section 311 of the Criminal Procedure Code following the striking out of a forfeiture application under the AMLATFPUAA. The application was dismissed. It was held that section 311 applies only where there is an executable judgment, order, conviction or sentence, which was absent in a mere striking out for procedural default. The Court further finds that a stay cannot be used to extend the statutory twelve-month lifespan of a seizure order. Allowing such relief would contravene Article 13 of the Federal Constitution. 1
