The sole issue arising for determination in Enclosure 1 is whether this is an appropriate case for the Court to exercise its discretion to extend time for the Plaintiff to file a Notice of Appeal out of time. 6. At its core, the application raises the question whether the Plaintiff’s non-compliance with the prescribed time limit under the Rules of Court 2012 for filing a Notice of Appeal should attract the consequence of refusal of an extension, thereby bringing finality to the litigation, or whether the circumstances justify the grant of indulgence so as to permit the intended appeal to be heard and determined on its merits. 7.
