An appellate practice spanning criminal and civil work, turning on the identification of evidential gaps and misdirections in the court below, from a discharged drug prosecution to a Sessions Court civil appeal.

Sean Dudley & Associates is recorded in the corpus in appellate litigation across the criminal and civil divides. A pair of linked Court of Appeal matters, in which the firm acted for the respondent, arose from a drug prosecution under the Dangerous Drugs Act 1952: at the close of the prosecution case the trial judge had found that the prosecution failed to make out a prima facie case on all four charges and the accused were dilepaskan dan dibebaskan (discharged and acquitted), and the Pendakwa Raya (the Public Prosecutor) appealed. A majority of the Court of Appeal dismissed the prosecution's appeal, with one judge dissenting, the majority reasoning that there were gaps in the prosecution case capable of raising doubt as to whether the respondents possessed the dangerous drugs — including gaps in a key witness's account of events in the main room of the house, inferences that could point away from possession, and an unexplained pink bag about which the prosecution had failed to question the witness. In a separate High Court matter the firm appeared for the appellant in a civil appeal from the Sessions Court after a full trial, arguing that the Sessions Court judge had misdirected himself in appreciating the evidence and engaging sections 101, 102 and 114(g) of the Evidence Act 1950 on burden of proof and adverse inference, and the requirements for a valid contract under the Contracts Act 1950; that appeal was allowed. Across these matters the firm is recorded conducting appellate advocacy in which the outcome depends on the careful identification of gaps and misdirections in the tribunal below — whether the prosecution's failure to close evidential gaps in a drug case, or a Sessions Court judge's erroneous appreciation of the evidence in a civil claim. In the drug appeals the majority's reasoning focused on an unexplained pink bag and on gaps in a key witness's account of events in the main room of the house, matters the prosecution had failed to close on re-examination.
