The plaintiff applied for an interlocutory injunction to restrain the 1st defendant from disposing of property pending trial. The application arose from an alleged agreement to purchase a house which collapsed after the plaintiff refused to sign a consent form required for a guarded community. The application was dismissed. No concluded contract existed. Balance of convenience did not favour the plaintiff and damages were an adequate remedy. The court also held that the registered caveat sufficiently protected the plaintiff’s alleged interest in the property.
