Orders of this Court [48] Based on the evidence and the assessment as stated above, with the application of the relevant laws, this Court finds that the Plaintiff has proven his claim on a balance of probabilities. Therefore, this Court’s orders are as follows: (a) The 1st, 2nd and 3rd Defendants have breached the revised sale and purchase agreement pertaining to the Land (b) The 1st, 2nd and 3rd Defendants have wrongfully terminated the revised sale and purchase agreement pertaining to the Land (c) The 1st, 2nd and 3rd Defendants return of the deposit paid of RM39,550.00 to the Plaintiff forthwith (d) The 1st, 2nd and 3rd Defendant pay to the Plaintiff general damages in the sum of RM237,330.00 (e) Interest of 5% per annum on the judgment sums awarded by this Court from the date of this judgment until full and final settlement (f) Costs of this proceeding is awarded to the Plaintiff. The 1st, 2nd and 3rd Defendants are to costs of RM20,000, subject to allocator.
