Introduction 1.The Defendant appeal to this Court is against the decision of the learned Session Judge who had dismissed the Defendant’s application for a stay proceedings in the Sessions court until the disposal of a family dispute in the Family High Court Kuala Lumpur. 2.This appeal is made under order 55 Rule 1 of the Rules of Court 2012 (“the Rules’) which stipulates: Notice of Appeal against any decision other than a decision made after trial (O. 55 r. 5) An appeal from any decision other than a decision made after trial by the Subordinate Court shall lie to a Judge in Chambers of the High Court. Conclusion 12.In the upshot the Court dismissed the Defendant’s appeal with a cost of RM3, 000.
