Case Significance
Illustrates a maritime drug interception, the operation of the section 37(da) trafficking presumption under the Dangerous Drugs Act 1952, and the insufficiency of a bare denial to rebut that presumption.
This High Court decision at Johor Bahru concerns a drug-trafficking prosecution arising from a maritime interception in the waters off West Johor, and it illustrates the operation of the trafficking presumption where a defence amounts to a bare denial. The accused was charged under seksyen 39B(1)(a) Akta Dadah Berbahaya 1952 (section 39B(1)(a) of the Dangerous Drugs Act 1952), punishable under section 39B(2), for trafficking in 325.12 grams (net) of methamphetamine on board an unregistered fibre boat at a stated position some 3.7 nautical miles from Tanjung Piai, in the district of Pontian, Johor. The prosecution's case was that a Malaysian Maritime Enforcement Agency patrol, conducting an operation in the waters of West Johor, encountered the boat and made the arrest and seizure. At the close of the prosecution case the court found that a prima facie case had been established and called on the accused to enter his defence, which cast on him the burden of rebutting the presumption of trafficking under section 37(da) of the Act. The accused elected to give sworn evidence, but the court found that his defence was no more than a bare denial. The central question was whether that denial was capable of rebutting the statutory presumption or raising a reasonable doubt in the prosecution's case. The court held that the accused had failed to rebut the presumption under section 37(da) and had not raised a reasonable doubt, so that the prosecution had proved its case beyond reasonable doubt. Convicting the accused, the court imposed the sentence of imprisonment for life together with twelve strokes of whipping, observing that this was the minimum that could be imposed and was just and in accordance with the law; the accused appealed to the Court of Appeal. The judgment is a useful illustration of a maritime drug interception, the operation of the section 37(da) trafficking presumption, and the insufficiency of a bare denial to rebut it.
