The second defendant failed to pay by the deadline, and its attempt to pay late on 6 August 2024 without the plaintiff's consent, the plaintiff said, did not preserve the option. Thereafter the first defendant, the second defendant's solicitor, registered a private caveat over the property on 15 August 2024 for the second defendant, although the option had lapsed; the caveat was only withdrawn on 22 December 2024. By originating summons the plaintiff sought declarations that the option was invalid, immediate removal of the caveat, an order restraining any further caveat, and damages for loss caused by the caveat.
