Abstract This is an application for inquiry under the Mental Health Act 2001 to determine if an 85-year-old father was mentally incapable of managing himself and his affairs. The application cited inappropriate messages and dementia medication as evidence of mental disorder. The Court found no medical diagnosis of mental illness and questioned the applicant's motives given concurrent lawsuits over family assets. The judgment establishes that mental health inquiries require both clinical evidence of illness and functional evidence of incapacity. The Court dismissed the application, emphasising that the legislation cannot be used to advance commercial interests.
