The defendant claimed a caveatable interest based on a sale and purchase agreement and alleged full payment of the purchase price. The Court found that the defendant failed to produce Form 19B, prove a concluded and enforceable contract or take timely action for specific performance. Applying the Luggage Distributors three-stage test, the Court held that no caveatable interest or serious question arose. The caveat was ordered removed with costs.
