Under enclosure 1 herein (Enclosure 1), the Appellant has applied to set aside pursuant to inter alia section 18(8) and 37(1) of the Arbitration Act 2005 the partial Award (Partial Award) given by the Learned Arbitrator (“Arbitrator”) on 1.3.2024 whereby the Arbitrator had ruled that the Arbitrator had jurisdiction to hear and dispose of the dispute between the Appellant and Respondent herein as a result of the termination of the Letter of Award dated 18.4. 2018 (“LOA”) which terminated the contract between the 2 parties.
