This appeal is against the decision of the learned Session Court Judge, which dismissed the appellant's claim as plaintiff for losses arising from the respondent's alleged refusal and/or failure to provide timely cooperation and approval for renovations at the tenanted premises. The plaintiff claims that this act by the respondent as defendant in the court below prevented it from operating its restaurant and bar business. In this regard, the court finds that the defendant acted unreasonably by withholding consent. As a result of the findings the court has made, the court finds that the learned Sessions Court Judge's decision contains appealable errors. The appeal is therefore allowed with costs.
