1. This is an application by the Plaintiff, as contained in Enclosure 1, seeking an order for the removal of a private caveat lodged by the Defendant against a parcel of land which the Plaintiff successfully purchased at a public auction. Although the Plaintiff has been declared the successful bidder, the registration of the property in the Plaintiff’s name has been impeded by the subsistence of the said private caveat. 2. As expected, both the Plaintiff and the Defendant have advanced arguments in support of their respective positions. Central Issues 3. The core issues for determination in this case is whether the Plaintiff has established, to the satisfaction of this Court, that it is an “aggrieved person” within the meaning of section 327 of the National Land Code, and whether the Defendant has satisfied the legal requirements for the entry and continued subsistence of the private caveat in question.
