Catchwords

A criminal charge must disclose the essential ingredients of the offence, but failure to specify every distinct act under s. 3(1) of the Kidnapping Act 1961 does not render the charge a nullity if the offence of kidnapping for ransom is sufficiently pleaded. Such particulars are not mandatory ingredients but details, and their omission does not mislead the accused. Accordingly, the High Court erred in holding the charge defective, and appellate intervention was warranted to remit the case for determination on the evidence.
