This High Court decision at Johor Bahru, delivered by Noor Hisham bin Ismail J, concerns a dispute over land in the Kulai district of Johor that had been the subject of a distribution order made by the Land Administrator. The plaintiffs and the defendants are members of the same family. A half share of the land had been held by one party as trustee, the land having earlier been alienated and dealt with, and there was a petition for a small estate. A significant feature was that the plaintiffs were said to have agreed not to claim any rights over the land. By the originating summons, the plaintiffs sought relief in relation to the land notwithstanding that background.
The Court examined the effect of the distribution order and of the plaintiffs' earlier agreement not to assert rights over the land, together with the trust arrangement under which a half share was held. A distribution order made by the Land Administrator in a small-estate proceeding regulates how a deceased's land devolves, and where an heir has agreed not to claim rights over the property that agreement bears on any later assertion of an interest. The question was therefore whether, given the distribution order and the plaintiffs' prior position, they could now maintain the claim advanced in the originating summons, or whether that claim was precluded by what had gone before and by the terms on which the land had been dealt with.
The Court concluded that the plaintiffs' claim could not be sustained. It dismissed the originating summons (Enclosure 1), with costs to be paid by the plaintiffs to the first defendant only.
