Applicants in all three cases filed similar nature of applications against the same Respondent – removal of caveats filed by the Respondent over their lands. One Grounds of Judgment is prepared which shall apply, mutatis mutandis, to all three appeals. This Court is satisfied that the Respondent failed to show he has any caveatable interests on the lands pursuant to s. 323(1)(b) NLC for the two private caveats to be maintained. Based on the foregoing, this Court allowed the applications in Cases 229, 230 and 240 with costs. The Private Caveat No. 2336/2023 for GM 1976, and the Private Caveat 2722/2023 for PN 192 are hereby ordered to be removed.
