Catchwords

Appeal against the decision of the Director General of Manpower dated 21.8.2024 wherein a part of the Respondent's claim for salary in lieu of notice was allowed. The Appellant argued that the Respondent was not an employee and that therefore exempt from the protection under Act 265 and that he agreed to receive one month's salary in lieu of notice. The Court held that the Respondent is an employee and that in the settlement agreement, the Respondent did not waiver his right to the full salary in lieu of notice. Appeal dismissed.
